Terms of Service
These Terms of Service ("Terms") govern your use of our website, mobile application, and any other services we provide (collectively, the "Service" or "Services"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
Eligibility
To use our Services, you must agree to enter into a legally binding contract with us and not be prohibited from receiving services under applicable laws. You must be at least 13 years old to use our Services. If you are accepting these Terms and using the Services on behalf of an organization or legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and the terms "you" and "your" will refer to that entity.
Privacy Policy
Our Privacy Policy outlines the manner in which we collect, use, and handle the information you provide when using our Services. By using our Services, you acknowledge and agree that you have read and understood our Privacy Policy, and you consent to the collection, use, storage, processing, and transfer of your information as described therein. This may include the transfer of your information to the United States, United Kingdom, and/or other countries where we and our affiliates operate, for the purposes of providing and improving our Services. Your information will be handled securely and in accordance with applicable data protection laws. If you have any questions or concerns about how your information is being used, please refer to our Privacy Policy or contact us directly.
Content
When using our services, it's important to follow the law and only share content you're comfortable with others seeing. Remember, you're using the services and any information you find through them at your own risk. We can't promise that everything you see will be 100% accurate or reliable, and sometimes you might come across things that are offensive or misleading. The person who shares something is the one responsible for it. We don't check all the content shared on our platform, but we can remove things that break our rules, like content that's illegal, copies someone else's work without permission, pretends to be someone else, breaks the law, or is harassing.
Your commitments
To make sure we can offer our service, we need you to agree to some rules to join the Tenetic community. Our goal is to keep our service open to everyone, but also safe, secure, and lawful:
- You should be at least 13 years old to use Tenetic.
- You can't use our service if the law says you’re not allowed to or if you're on any list that bans you from being involved in payment services.
- If we've ever removed your account because you broke a law or any of our rules, you can't join.
- You can't use Tenetic if you're a convicted sex offender.
- You can’t post any nude or adult content.
To keep Lyrak safe and welcoming for everyone, we all need to follow some rules:
- Don’t pretend to be someone else or give false information. You don’t have to reveal who you are on Tenetic, but any information you give us must be true and current. Don’t impersonate others, and only create accounts for others if you have their explicit permission.
- Don’t engage in illegal activities, deceive others, or use Tenetic for unauthorized purposes.
- Follow our Terms and policies, especially the Tenetic Community Guidelines.
- Don’t disrupt the service or misuse any way to report problems or appeal decisions, like making false reports.
- Don’t try to hack the system to create accounts, gather information without permission, or collect data through automated means without our okay.
- Don’t sell, buy, or trade any part of your account or any data you get from us or through Tenetic. This includes not trading usernames, asking for other people’s login details, or trying to transfer any part of your account (like your username).
- Don’t share other people’s private or confidential information without their consent, and respect everyone’s rights, such as copyright and trademarks. If you use someone else’s content, make sure it’s allowed by law or that you have the right to use it.
- Don’t change, translate, make new versions of, or try to figure out how our products are made.
- Don’t use a web address as your username unless you have our permission first.
- Don’t post nude or adult content.
Permissions you give us
By using our service, you’re giving us the permissions we need to operate that service effectively. Your content is your own. We do not claim ownership of the things you post on or through the service, and you are free to share your content with anyone, anywhere. However, to help us provide the service, you grant us a type of permission known as a "license" to use your content. This means that when you upload or post content, such as text or pictures, you are allowing us to host, share, tweak, copy, and use that content worldwide. This permission enables us to display your content, share it within our internal networks, translate it for display in other languages, and copy it from one server to another in ways that match your privacy settings. This license ends when you delete your content or your account, but remember, the content might remain in backup storage for a while. You also give us permission to use your username, profile picture, and information about your interactions. If you choose a username or any other identifier for your account, we might change it if needed (for example, if it violates someone else's rights or mimics another user). When you use any content that we own and provide in our Service (like images, designs, videos, or sounds that you incorporate into your own content), remember that we keep all rights to our content. You're allowed to use our intellectual property (like trademarks) only if you follow our Brand Guidelines or if you've got our explicit written approval. To alter, make new versions of, or uncover the source code of our content, you'll need to get our written consent or ensure it's allowed under an open-source license. Lastly, you agree that we can automatically download and install updates to our app on your device.
AI
Users retain full ownership and control over their AI models created using the app's tools and features. Tenetic will not use user-generated AI models for its own purposes. Tenetic will not use user-generated content, including photos and AI models, to train our own AI algorithms or models. User data will be kept separate from the app's internal AI development processes. Users have the right to monetize their AI models as they see fit, subject to applicable laws and regulations. Users are responsible for the content generated using the app's AI tools and features. Users must not use the app's AI tools to create content that infringes on intellectual property rights, promotes hate speech, or violates applicable laws. Users retain ownership of their AI entities and have the right to use them for personal or commercial purposes, subject to the app's guidelines.
Using the Services
Please make sure to follow our rules and guidelines, which you agreed to when signing up. These rules help us keep the platform safe and enjoyable for everyone. Remember, you should only use our services in ways that follow these rules and all other laws.
Our platform is always changing and improving. This means we might add, change, or remove features, and we can also limit or stop providing the service to anyone at any time. We also have the right to manage how much content you can store and may remove content or take action against accounts that break our rules.
By using our platform, you're okay with us showing ads alongside the content. This includes ads on content you or others submit. We may also look at and share information if we need to for legal reasons, to enforce our rules, to keep the platform secure, to help users with problems, or to keep our platform safe and running smoothly. We promise to protect your personal information according to our Privacy Policy.
If you use special features or services we offer, there might be extra rules or fees. If you decide to use these services, you'll also need to agree to those extra rules, which will become part of our agreement with you. If there's a conflict between the main rules and the additional terms, the additional terms will apply to those specific services.
Your License
We're granting you a personal, global, royalty-free, and non-exclusive license to use the service included in our services at no cost, but you can't transfer this permission to someone else. This is solely for your use to fully enjoy our services as provided, in accordance with our rules.
Our services are protected by laws in the United Kingdom and other countries, including copyright and trademark laws. Our terms don't allow you to use our brand name, logos, or any other trademarked features without our permission. Everything about the services, except what users like you contribute, belongs to us and the people we work with. If you have any ideas or feedback about our services, you're free to share them, but we're not required to use them or pay you for them. We can use your suggestions in any way we choose.
Misuse of the Services
You agree not to misuse our services. This means you shouldn't interfere with our services or try to access them in any way other than how we've told you to. Specifically, you can't get around any technical restrictions in our services, or try to take it apart or figure out how it works unless the law clearly allows it. Here’s what you should not do:
- Don't access or interfere with parts of our services or systems that aren't meant for public use.
- Don't try to test, scan, or check our system or network for weaknesses, or break through our security measures.
- Don't use any tools or methods to search or access our services other than the public interfaces we provide, unless you've got our written permission.
- Don't fake any data in emails or posts, or use our services to send misleading information.
- Don't do anything that goes against our rules on manipulating our platform or spreading spam.
- Don't overload, flood, spam, or harm our services in any way, or create content automatically in a way that burdens our services.
Also, helping others break these rules or sharing tools that encourage breaking them is against our terms.
Content removal and disabling or terminating your account
If your content or behavior doesn't align with our Terms of Use or policies (like our Tenetic Community Guidelines), or if the law requires, we may remove your content or restrict your use of the Service. This includes the possibility of refusing service, terminating, or disabling your access immediately if your actions pose risks or legal issues for us, violate our terms or policies, infringe on others' intellectual property rights, or if required by law. We may also end or modify the Service, block or remove content, or stop offering the Service entirely if we believe it's necessary to avoid legal or regulatory consequences.
When content is removed, we'll try to inform you and explain any review options available, except in cases of severe or repeated violations, legal liability, harm to our community, technical limitations, or legal restrictions. If you think your account was wrongly terminated, or if you wish to disable or delete your account, you can find guidance in our Help Centre.
Content deletion requests start within 30 days and the process may take up to 90 days, during which the content isn't visible to others. It might take an additional 90 days to remove from backups.
Content won't be deleted within 90 days if:
- Others are using your content under this license and haven't deleted it yet.
- Technical limitations delay the deletion, but we'll complete it as soon as possible.
- Deletion would hinder our ability to investigate illegal actions, ensure the safety of our products and users, comply with legal duties, or respond to government or law enforcement requests. We'll keep the content only as long as necessary for these purposes.
If your account is deleted or disabled, this agreement ends, but certain sections, including this one and the section on resolving disputes, will still apply.
Disclaimers
When you use our services or any content we provide, you're doing so at your own risk. We offer our services "as is" and "as available," without making any promises about their reliability, safety, or availability. The term "Tenetic" includes our company, and our employees, agents, and licensors. To the fullest extent allowed by law, we're not making any guarantees that our services will meet your needs, will always work the way you want, will be safe, or will be error-free.
We're also not responsible for any mistakes or missing information in the services, any damage to your computer or loss of data from using our services, any content that gets lost or not saved correctly, or if our services don't meet your expectations. Remember, getting advice or information from us doesn't create any new promises or guarantees beyond what we've expressly stated.
Limitations of Liability
Under the law, to the fullest extent possible, Tenetic won't be responsible for any indirect, accidental, special, major, or punishment-based damages, or any lost profits or revenues, whether they happen directly or indirectly. This includes any loss of data, opportunity, goodwill, or other unseen losses that might come from using or not being able to use our services, anything wrong or offensive other users or third parties might do on our services, any content you get from our services, or if someone unauthorized accesses or changes your information or content.
If anything does go wrong, the most we might have to pay you is either $100 or whatever you've paid us for the services in the last six months, whichever is more. This cap applies no matter what the issue is based on, like warranty, contract, law, or even if we're told ahead of time that such damage could happen. This limit is there even if the usual ways to fix these issues don't work out.
General
We might update these Terms from time to time. Any changes won't apply to the past, and the latest version, which you can always find at Tenetic.app/terms, will apply to our relationship with you. We'll do our best to let you know when there are significant changes, either through a message on our service or an email to your account's email address. If you keep using the Services after these changes, that means you agree to the new Terms. Also, by law, you're giving up the right to join in any class action lawsuits against us related to these Terms.
English law applies to this agreement and English courts will settle disputes.
These Terms are originally in English, but we might translate them into other languages. If there's a difference between the English version and a translated version, the English version takes priority. This means the English version will be the main one used for understanding and interpreting our agreement.
If part of these Terms is found to be invalid or can't be enforced, we'll trim or remove that part as little as needed, and the rest of the Terms will still fully apply. Just because we might not enforce a part of these Terms right away doesn't mean we're giving up our rights to do so later.
